Welcome to the Last Person Standing (LPS) application ("App," "we," "us," or "our"). By accessing or using the App, including syncing data from third-party services (such as Fitbit, Garmin, Apple Health, or Google Health Connect), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
The LPS Challenge service is operated by Little Scarletto Apps Inc., a corporation incorporated under the laws of Ontario, Canada (referred to in this document as "we," "us," or "our").
CRITICAL NOTICE: THIS APP DOES NOT PROVIDE MEDICAL ADVICE.
1.1. Consult Your Physician: The LPS App is designed for fitness tracking, motivational challenges, and entertainment purposes only. The information, services, and challenges provided by this App and related services are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a physician or qualified healthcare provider before beginning any new exercise program, diet, or fitness challenge.
1.2. Assumption of Risk: Participation in the Last Person Standing challenges (including high-volume Zone 2 cardio activities) carries inherent risks, including but not limited to physical injury, exhaustion, or adverse health events. You acknowledge that you are voluntarily participating in these activities at your own risk.
1.3. No Direct Liability: To the maximum extent permitted by applicable law, the App, its developers, operators, owners, and holding companies shall not be held liable for any personal injury, bodily harm, property damage, or wrongful death resulting from the use or misuse of the App, the interpretation of data within the App, or participation in any fitness challenges orchestrated through the App.
2.1. Health Data Access: By connecting third-party services (e.g., Fitbit, Garmin, Apple Health, Google Health Connect), you explicitly grant the App permission to access, read, and store your fitness activity data, including heart rate logs, session durations, and timestamps, solely for the purpose of calculating "Zone 2+" minutes and determining challenge standings.
2.2. Accuracy of Data: We do not guarantee the accuracy, reliability, or completeness of health data synced from third parties. We are not responsible for errors, delays, or issues stemming from the API endpoints or services of Fitbit, Garmin, Apple, or Google.
3.1. The LPS App automatically tracks and calculates accumulated "Zone 2+" minutes against weekly thresholds.
3.2. Decisions made by the App’s algorithm regarding elimination or threshold completion are final for the purposes of the digital challenge. We reserve the right to correct algorithmic errors or address cheating if applicable.
By registering for the App, you agree NOT to:
5.1. Limitation of Liability: In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or related to your use of the App.
5.2. Indemnification: You agree to indemnify, defend, and hold harmless the LPS App, its developers, officers, and affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your participation in related fitness activities.
The App is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be undisrupted, 100% secure, or completely error-free.
